It is shameful….Each justice has four clerks so that’s 36 law clerks. And there are a handful of clerical assistants and secretaries who might have it. I think the chances are zero that it is a Justice. I cannot believe any justice would be part of such a grave betrayal of the institution. According to The Hill, “Three conservative Senate Republicans on Monday filed an amicus brief urging the Supreme Court to overturn its landmark precedents that protect the constitutional right to abortion. In a 33-page brief, Sens. Josh Hawley (R-Mo.), Mike Lee (R-Utah) and Ted Cruz (R-Texas) asked the court to use a Mississippi case to be reviewed next term as a vehicle to overturn Roe v. Wade and related rulings. Calling the status quo ‘untenable,’ the senators said the legal doctrine on abortion that emerged over roughly the past five decades since Roe was decided in 1973 has given judges excessive discretion and proven unworkable. ‘Roe and Casey should be overruled, and the question of abortion legislation should be returned to the states,’ they wrote, referring also to the court’s 1992 decision in Planned Parenthood v. And reasonable people disagree on this question and disagree strongly. I am pro-life I believe that every life is a precious gift from God. And that the law should protect every life. But but there are many people who disagree with that proposition. And the Constitution sets up as a system where each state can resolve those matters differently in a way that reflects the values and the mores of their citizens. In 1973, in Roe versus Wade, seven unelected judges, decreed that the American people have no right to resolve these questions, that they knew better than then than we did. And Roe vs. Wade was wrong the day it was decided. It was grotesquely inconsistent with the Constitution and it's produced an awful lot of the angry division we have on this question because people have been frustrated that they couldn't go to the democratic process to resolve it, that instead unelected lawyers in robes were decreeing that we must obey them. If the Court follows through and overrules the decision, it doesn't mean that abortion is illegal across the country, it means that each state will will pass laws that reflect the values of their citizens, and that's the way the Constitution was designed." I think he can pass it through the House. They've got a majority in the House. And I think the Democrats will stick together. And you may have a couple of Republicans in the House. I don't, I haven't followed the kind of abortion lines in the House, but there may well be some pro-choice Republicans in the House. In the Senate he will not get it done. Because to get it done will require sixty votes because of the filibuster. He would get, he'll get all fifty Democrats and I'm sure will vote on it. He will get Susan Collins and I think he will likely get Lisa Murkowski. You get to fifty-two. I don't know that you get any higher. The other forty-eight are on record that Roe is wrong.
